Our Policy Director, Shelmun Dashan, was quoted this week in a Capitol Forum article, “Super.com's Allegedly Deceptive Billing and Subscription Practices Draw Widespread Customer Complaints, May Raise Consumer Protection Concerns.” The piece examines a wave of consumer complaints suggesting that Super.com, a financial services and travel booking company, may be using deceptive billing and subscription tactics while targeting low-income consumers.
Shelmun noted that these practices could expose the company to liability under the Restore Online Shoppers’ Confidence Act (ROSCA), which requires vendors of subscription-type agreements to clearly disclose transaction terms, secure consumers’ affirmative consent before charging them, and offer an easy way to cancel recurring charges. She added that Super.com could also face scrutiny under state autorenewal laws and state Unfair and Deceptive Acts and Practices (UDAP) statutes.
